Benue gov poll: Appeal court upholds Ortom’s election

Benue State Governor

The Court of Appeal sitting in Makurdi, on Wednesday upheld the verdict of the Election Petition Tribunal which affirmed the qualification and election of Samuel Ortom as governor of Benue State.
The governorship candidate of the Peoples Democratic Party had asked the court to reverse the tribunal’s judgement and declare him winner of the April governorship election in the state.
He said that the tribunal erred in its judgment as Mr. Ortom was not qualified to contest in the election.
He said Mr. Ortom was not validly nominated by the All Progressives Congress to stand for the election.
He had sought a declaration by the appellate court to set aside the tribunal’s judgement which had dismissed his petition for lack of merit.
Mr. Tarzoor had also asked the court to direct the Independent National Electoral Commission to declare him winner of the April governorship poll.

In its argument, the APC had insisted that its candidate was validly nominated in conformity with the requirements of the Electoral Act, 2010, adding that the burden of proof rests on the shoulders of the appellants.
All parties in the case – APC, PDP, INEC – had filed cross appeals and cross appellant appeals challenging certain aspects of the tribunal’s judgment.
However, in a unanimous decision read by Justice Mohammed Garba, the court dismissed the appeal in its entirety for lack of merit.
Mr. Garba said the appellants failed to discharge the burden of proof which rested on them, in line with the legal dictum that ” he who alleges must prove”, adding that the lower court was right in dismissing the petition.
Reacting to the judgment, counsel to the PDP, Donald Kertyo, said his team would test the ruling at the Supreme Court

Patrick Vieira has been appointed the new manager of Manchester City's sister club New York City on a three-year deal.

Patrick Vieira has been appointed the new manager of Manchester City's sister club New York City on a three-year deal.
The former Arsenal and France captain steps up from his role as the head coach of City's Elite Development Squad, which he has held since June 2013.
Vieira succeeds Jason Kreis, who was sacked last week after failing to take New York City to the MLS play-offs in their inaugural season in the league.
The Frenchman said: 'I am delighted to take up the role of head coach of New York City. To work with this squad, with Claudio Reyna [sporting director] and Rob Vartughian [coach] and the fantastic support team that is in place is an exciting prospect for any coach.
'I would also like to thank everyone at Manchester City and most of all Brian Marwood, my coaching and support team and of course the wonderful young men who make up the Elite Development Squad, for all of their support and commitment and for making my time here so stimulating and enjoyable.
'They are good footballers and good people and I know that they will continue to go from strength to strength in their careers.'
Under Vieira's leadership, the EDS have secured a Premier League International Cup and currently top their group in the UEFA Youth League.
City director Marwood, also a former Arsenal midfielder, said: 'Patrick is a special individual and a rare talent ... I have no doubt that he will thrive at New York City and all of those who work with him in Manchester wish him all the very best in his new role.'
New York City finished the MLS season with just 37 points – the second lowest total in the league - despite making the high-profile signings of Frank Lampard, Andrea Pirlo and David Villa.
Vieira begins his new role on January 1 ahead of the new MLS season which starts in March.
